SHRM Workplace Domain Exam Tips - How to Pass

Expert tips for the SHRM-CP and SHRM-SCP Workplace domain. Study strategies for employment law, risk management, workplace safety, and global HR.

Workplace Domain Overview

The Workplace domain accounts for approximately 13% of the exam and covers US employment law, risk management, workplace safety, corporate social responsibility, and global HR. This is the most law-heavy domain, so expect many knowledge-based questions testing your understanding of specific statutes, regulations, and compliance requirements.

What to Study First

  1. Major Employment Laws: Title VII, FLSA, FMLA, ADA, ADEA, Equal Pay Act, PDA, GINA, and OSHA. For each law, know the coverage threshold (how many employees trigger compliance), key provisions, protected classes, and common exam scenarios.
  2. Anti-Discrimination Concepts: Disparate impact, disparate treatment, BFOQ, retaliation, protected classes, and the EEOC complaint process.
  3. Workplace Safety: OSHA general duty clause, recordkeeping requirements (300 log), workplace violence prevention, and workers' compensation basics.
  4. Risk Management: Employment practices liability, data privacy, business continuity, and HR's role in organizational risk assessment.
  5. Global HR: Expatriate management, host country vs. parent country nationals, global compensation approaches, and cross-cultural management.

Employment Law: Your Study Priority

Employment law questions make up the largest portion of this domain. Build a reference chart with these details for each major law:

  • Coverage threshold: Title VII and ADA (15+ employees), ADEA (20+), FMLA (50+ within 75 miles), FLSA (most employers)
  • Protected characteristics: Know exactly what each law covers. Title VII covers race, color, religion, sex, and national origin. ADA covers disability. ADEA covers age 40+.
  • Key provisions: FMLA provides 12 weeks unpaid leave. FLSA requires overtime at 1.5x after 40 hours. ADA requires reasonable accommodation unless undue hardship.
  • Filing deadlines: EEOC charges generally must be filed within 180 days (300 days in states with fair employment practice agencies).

Studying by Knowledge vs. Competency

The Workplace domain leans more toward knowledge items (testing what you know) than behavioral competency items (testing judgment). However, some SJIs appear. To prepare for both:

  • Knowledge items: Use flashcards, practice exams, and memorization for laws, thresholds, and definitions. There is no shortcut for these.
  • SJIs: When a scenario involves a potential legal violation, the correct answer almost always involves investigation first, followed by appropriate corrective action. Avoid answers that skip the investigation step.

Key Distinctions That Appear Repeatedly

  • Disparate impact (neutral policy with discriminatory effect) vs. disparate treatment (intentional discrimination against an individual)
  • Exempt (salaried, no overtime, must meet duties test) vs. non-exempt (hourly or salaried, entitled to overtime)
  • Reasonable accommodation (ADA, religious practices) vs. undue hardship (significant difficulty or expense that excuses the employer)
  • FMLA leave (job-protected, unpaid, 12 weeks) vs. ADA leave (reasonable accommodation, duration depends on circumstances)
  • Quid pro quo harassment (submission to conduct is tied to employment decisions) vs. hostile work environment (severe or pervasive conduct that alters working conditions)

Global HR Tips

Global HR questions are less frequent but can catch candidates off guard. Focus on:

  • The difference between ethnocentric, polycentric, regiocentric, and geocentric staffing approaches
  • Balance sheet approach vs. localization for expatriate compensation
  • Cultural dimensions (Hofstede, Trompenaars) and their impact on HR practices
  • Challenges of cross-border compliance and data privacy (GDPR awareness)

Practice Under Timed Conditions

Because this domain is law-heavy, you may find yourself spending too long verifying legal details in your memory. Practice with timed exams to build speed and confidence. If you do not know a legal threshold or provision, make your best choice and move on. Spending 5 minutes on one law question costs you time for three other questions.
